Terms of Service

Thank you for choosing DeWonder Travel Limited (Travel Agent Licence No.: 354384). By registering for / purchasing any of our travel services (as set out below), you agree to be bound by these Terms and Conditions. Please read the following Terms and Conditions carefully before submitting your registration form / order.

A. Tours and Services
  1. DeWonder Travel Limited's scope of services includes organising and operating tours, free independent travel, optional add-on services and individual travel services (collectively, the "Travel Services"). Details of the Travel Services are set out in the information pack (the "Information Pack"), which includes relevant information / materials provided by DeWonder Travel Limited or its business partners through the operating website, email, online resources and other means.
  2. Where it deems appropriate, DeWonder Travel Limited may authorise and/or engage its business partners, contractors and/or third-party service providers to provide any or all of the Travel Services, including but not limited to transportation, accommodation, meals, sightseeing, tours, local activities, optional add-on services and individual travel services (the "Entrusted Services"). You agree to accept the Entrusted Services provided by the relevant business partners, contractors and/or third-party service providers authorised and/or engaged by DeWonder Travel Limited. DeWonder Travel Limited will, within reason, supervise the Entrusted Services to ensure service quality, and shall not be liable for matters beyond its reasonable scope of supervision.

Tours

  1. Tours are outbound travel services offered by DeWonder Travel Limited and open to the public for registration. The services included and other detailed information are set out in the Information Pack. Unless otherwise specified, you must register for a tour in accordance with the guidelines set out in the Information Pack.
  2. Tour places are allocated on a first-come, first-served basis, determined by payment of the deposit and submission of the registration form. Unless you have received written notice from DeWonder Travel Limited, merely paying any or part of the tour fee to DeWonder Travel Limited and/or submitting a registration form does not mean your registration has been accepted by DeWonder Travel Limited. DeWonder Travel Limited reserves the final right to accept or reject any registration.
  3. A tour will only proceed once it meets the minimum participation requirement (i.e. the minimum number of participants per tour as determined by DeWonder Travel Limited at its sole discretion). A tour will only be regarded as confirmed to proceed once you have received a written tour confirmation notice issued by DeWonder Travel Limited (the "Tour Confirmation Notice"). If your enrolment is not accepted or the tour fails to proceed and DeWonder Travel Limited notifies you in writing, you will be entitled to a refund in accordance with the terms set out in the following Cancellation of Travel Services and Refund Policy. Should you fail to comply with any requirement, including but not limited to paying the full tour fare by the payment deadline specified by DeWonder Travel Limited (unless otherwise specified, generally sixty days before the tour's departure), submitting valid travel documents and proof of visa, and submitting the relevant personal travel record and health declaration form, you will be deemed to have withdrawn from the tour on your own initiative, and no refund will be given except as provided in the following Cancellation of Travel Services and Refund Policy.

Independent Travel

  1. Independent Travel is a bespoke, privately commissioned package travel service arranged by DeWonder Travel Limited independently of any tour. Details of the Independent Travel will be provided to you by email or through a website operated by DeWonder Travel Limited or its business partners. If you wish to enrol in an Independent Travel, you should submit an order to DeWonder Travel Limited in writing and pay the deposit as instructed by DeWonder Travel Limited. The Independent Travel will only be regarded as confirmed to proceed once you have received a written Independent Travel confirmation notice issued by DeWonder Travel Limited (the "Independent Travel Confirmation Notice"). If your enrolment is not accepted or the Independent Travel fails to proceed and DeWonder Travel Limited issues the relevant notice in writing, you will be entitled to a refund in accordance with the terms set out in the following Cancellation of Travel Services and Refund Policy. Should you fail to comply with any requirement, including but not limited to paying the full Independent Travel fee by the payment deadline specified by DeWonder Travel Limited, submitting valid travel documents and proof of visa, and submitting the relevant personal travel record and health declaration form, you will be deemed to have withdrawn on your own initiative, and no refund will be given except as provided in the following Cancellation of Travel Services and Refund Policy.

Optional Add-on Services

  1. Optional add-on services are only available for selected tours/Independent Travel and require payment of additional fees. The services include travel insurance, flight packages, hotel accommodation and/or local travel services provided by third-party service providers. Detailed information is set out in the information pack.
  2. If you wish to purchase optional add-on services, you should, after DeWonder Travel Limited has issued the Tour Confirmation Notice/Independent Travel Confirmation Notice to you, submit an order to DeWonder Travel Limited in writing and pay the fees (including the service fees payable to the third-party service providers and DeWonder Travel Limited's handling fee) in accordance with the relevant guidelines. The optional add-on service will only be regarded as confirmed once you have received written confirmation from DeWonder Travel Limited.

Individual Travel Services

  1. DeWonder Travel Limited also provides, independently of any tour/Independent Travel/optional add-on services, booking services for travel insurance, flight packages, hotel accommodation and/or local travel services provided by third-party service providers (the "Individual Travel Services"). Details of the individual travel services will be provided to you via email and/or on websites operated by DeWonder Travel Limited or its business partners.
  2. If you wish to purchase individual travel services, you should submit an order in writing and pay the fees (including service fees payable to third-party service providers and the handling fee of DeWonder Travel Limited) to DeWonder Travel Limited in accordance with the relevant guidelines. The individual travel service shall only be regarded as confirmed once you receive written confirmation from DeWonder Travel Limited.
  3. In purchasing optional add-on services / individual travel services, you agree to be bound by these Terms and Conditions, and also agree to comply with the relevant terms and conditions and/or policies of each service provider. You confirm that you have carefully read and accepted the relevant terms before purchasing the optional add-on services / individual travel services. DeWonder Travel Limited issues to you the tickets, receipts and contracts for the optional add-on services / individual travel services in accordance with the relevant terms and conditions. Subject to the "Directives to Licensees" ("the Directives") issued by the Travel Industry Authority (the "TIA"), if a service provider cancels, delays or changes any optional add-on service / individual travel service (for any reason whatsoever), DeWonder Travel Limited shall not be liable for any loss, damage, costs or any other claims arising from such cancellation, delay or change, and you should negotiate and claim compensation directly with the service provider in accordance with the service provider's relevant terms and conditions and/or policies.
B. General Provisions
  1. DeWonder Travel Limited reserves the right tocanceldelayorchangetravel services where it considers necessary or due to "Unavoidable Circumstances (outbound travel)", and no refund shall be given except as provided in the Directives or the followingTravel Service Cancellation and Refund Policybelow. "Unavoidable Circumstances (outbound travel)" refers to war, political unrest, terrorist attacks, natural disasters, epidemics, inclement weather, technical problems with transport, temporary rescheduling or cancellation of services by carriers, strikes, industrial action, travel alerts (warnings) issued by the government of the travel destination or the World Health Organization, Red or Black Outbound Travel Alerts issued by the Government of the Hong Kong Special Administrative Region, force majeure events, and other circumstances beyond the control of DeWonder Travel Limited that are unfavourable to departing from Hong Kong or travelling outside Hong Kong.
  2. DeWonder Travel Limited reserves the right, in response to (i) exchange rate fluctuations exceeding 3% resulting in an increase in the cost of arranging the relevant tour; (ii) an increase in the cost of arranging the relevant tour due to unforeseeable circumstances; or (iii) an increase in air ticket costs due to fluctuations in fuel surcharges, to levy additional charges on customers who have enrolled in an outbound tourbeforethey have paid the full tour fee and other related fees. You may choose to accept the price adjustment and continue to participate in the tour, or withdraw from the tour and recover the fees already paid. Refund arrangements shall be carried out in accordance with the Directives.
  3. DeWonder Travel Limited shall not be liable for any loss, damage, costs and other related claims arising from the above changes, except as provided in this clause and the followingCancellation of Travel Services and Refund PolicyNo refunds will be given except as provided. You agree that if additional optional add-on service fees arise from changes to the tour/self-guided trip (such as changes to accommodation and/or transport arrangements), DeWonder Travel Limited may charge you the relevant optional add-on service fees or expenses for such changes. You also agree that, in order to ensure that the tour/self-guided trip you are participating in or the travel services you are using are not affected, you will make appropriate adjustments to your transport, accommodation, or travel document arrangements in response to any changes made by DeWonder Travel Limited to the travel services, and bear the related costs.
  4. Any transport, accommodation, sightseeing, meals, and other items arranged within the tour/self-guided trip are group bookings. Once confirmed and ordered, you may not request any changes, except as provided in the followingCancellation of Travel Services and Refund PolicyNo refunds will be given except as provided in the stipulated terms. If you have any requests that differ from the group arrangements (such as excluding certain ingredients due to sensitivities or personal dietary habits, or the need to arrange a specific menu), please raise them when signing up for the tour/self-guided trip. DeWonder Travel Limited may make corresponding arrangements and adjustments within a reasonable scope, and reserves the right to charge you additional fees arising from such adjustments, including but not limited to DeWonder Travel Limited's additional handling fees and the price difference of the related services.
  5. Some tours/self-guided trips already include transport arrangements between the meeting point and the travel destination. Such arrangements are group bookings, and you must travel to and from with the group. If you wish to stay at the destination or another city and not follow the tour/self-guided trip's own transport arrangements, DeWonder Travel Limited reserves the right to decide whether to accept your request, or to make corresponding arrangements within a reasonable scope, but you shall be responsible for and pay all liabilities and costs arising therefrom, including but not limited to the price difference of transport fees and DeWonder Travel Limited's additional handling fees. If DeWonder Travel Limited does not accept your request and you decide not to continue participating in the tour/self-guided trip, it shall be regarded as a voluntary withdrawal, and no refunds will be given except as provided in the followingCancellation of Travel Services and Refund Policystipulated terms.
  6. If you suddenly withdraw after the tour/self-guided trip has departed or decide not to participate in any group or itinerary-included activities (such as meals, sightseeing, or accommodation), it shall be regarded as voluntarily forgoing (part of) the itinerary. Fees paid will not be refunded, and DeWonder Travel Limited will not provide any alternative activities.
  7. Some tours/self-guided trips already include air tickets between the meeting point and the travel destination. According to airline guidelines, air tickets become invalid if not used in sequence. Therefore, if you are unable to board and depart with the group but wish to retain the seats for the remaining itinerary (including domestic, connecting, and return flights during the itinerary), the airline has the right to cancel the seats for the remaining itinerary, or charge you relevant handling fees, or require you to purchase additional air tickets. DeWonder Travel Limited shall not be responsible for any additional costs arising from this, and no refunds will be given except as provided in the followingCancellation of Travel Services and Refund Policystipulated terms.
  8. If you participate in an "activity that does not include transport and accommodation" 1or choose to purchase your own air tickets between the meeting point and the travel destination to participate in the tour/self-guided trip, all matters relating to the self-paid air tickets shall be borne by you. You must confirm with DeWonder Travel Limited whether the tour/self-guided trip will proceed and confirm the flight information for that tour before purchasing self-paid air tickets, otherwise all consequences shall be borne by you. If, due to any special circumstances beyond DeWonder Travel Limited's control—including but not limited to weather problems, machine failure, immigration restrictions, etc.—the group flight or your self-paid air ticket flight is unable to arrive on time or the destination is changed as a result, DeWonder Travel Limited shall not be responsible for any additional costs you incur as a result (including but not limited to transport costs for travelling to the latest meeting point on your own, etc.).
  9. As activities that do not include transport and accommodation do not fall within an outbound travel service package, the payments made by customers for such activities are not outbound fares, and licensed travel agents are not required to pay a levy on them, so such customers are therefore not protected by the Travel Industry Compensation Fund.
  10. Unless otherwise permitted in writing by DeWonder Travel Limited, DeWonder Travel Limited or its appointed third-party service providers reserve the right not to accept your unilateral change to have another person participate in the tour/self-guided trip on your behalf before departure, on the departure day, or during the trip. If you insist on changing the participant, DeWonder Travel Limited reserves the right to cancel your eligibility to participate in the tour/self-guided trip, and your registration will be regarded as a voluntary withdrawal. No refunds will be given except as provided in the terms stipulated in theCancellation of Travel Services and Refund Policyterms.
  11. Before signing up for a DeWonder Travel Limited tour/self-guided trip, please refer on your own to the relevant outbound travel alerts, immigration restrictions/requirements, etc. (if applicable) published and updated from time to time by the Hong Kong Government/the government of the travel destination. If, after signing up for the tour/self-guided trip, you decide on your own not to depart with the group due to reasons such as safety risks at the travel destination or the immigration policies of the Hong Kong/travel destination government, it shall be regarded as a voluntary withdrawal. Except as provided in theCancellation of Travel Services and Refund PolicyNo refunds will be provided except as stipulated.
  12. DeWonder Travel Limited reserves the right to combine tour groups of different durations for departure. For tours whose return journey comes first, once the itinerary at the overseas destination has concluded, no tour leader will accompany the group; instead, a dedicated vehicle will be arranged to take you to the local airport/station, and you must take the designated flight/train to reach the dispersal point on your own.
  13. Certain tours/free-and-easy packages may offer tour fee discounts or promotions. DeWonder Travel Limited reserves the right to make the final calculation and determination as to whether you are entitled to the relevant discounts or promotions.
C. Cancellation of Travel Services and Refund Policy

Cancellation of Tours and Free-and-Easy Packages

  1. DeWonder Travel Limited reserves the right to confirm that a tour cannot proceed due to reasons such as insufficient participants. In such cases, you may receive a refund of all amounts paid to DeWonder Travel Limited, less bank handling charges (if any).
  2. If a tour is marked as "Confirmed Departure", it means the tour already has enough participants; however, whether the tour departs is still subject to other factors, and DeWonder Travel Limited reserves the final decision. Should the tour be cancelled, DeWonder Travel Limited will make arrangements accordingly in line with the Directive.
  3. Under the Directive, if a licensed travel agentfor reasons other than force majeure (outbound)cancels an outbound tourbefore departureof that tour, it must notify customers in the following manner:

(a) (For cancellation of tours of three days or fewer) notify customers at least one day before departure (excluding both the day of notification and the day of departure);

(b) (For cancellation of tours of four to nine days) notify customers at least seven days before departure (excluding both the day of notification and the day of departure);

(c) (For cancellation of tours of 10 days or more) notify customers at least 14 days before departure (excluding both the day of notification and the day of departure).

If customers are notified of the cancellation of an outbound tour in accordance with the above requirements, the agent must, under the Directive, refund the amounts paid by customers or (if customers paid by credit card) submit a refund application to the card-issuing institution, and ensure, so far as practicable, that customers receive a refund of all amounts paid. If DeWonder Travel Limited fails to notify customers of the cancellation of a tour within the above time limits, it must, in accordance with the Directive, refund the amounts paid by customers and compensate the relevant tour fee.

  1. If DeWonder Travel Limited for reasons other than force majeure (outbound)cancels an outbound tour (where the tour is not an outbound package charter), and the customers of that tour have paid DeWonder Travel Limited a visa service fee or handling charge,then DeWonder Travel Limited must, under the Directive, refund the amounts paid by customers or (if customers paid by credit card) submit a refund application to the card-issuing institution, and ensure, so far as practicable, that customers receive a refund of all amounts paid. If DeWonder Travel Limited has already processed a visa on behalf of a customer that is not a group visa, it may deduct from the refund to the customer an amount equal to the visa fee already paid by DeWonder Travel Limited.
  2. a package tour for outbound travel that has been guaranteed to depart, but where the licensed travel agent subsequentlyfor reasons other than force majeure (outbound travel)cancels the tour, the agent must, within seven working days after issuing the cancellation notice (excluding the day the notice is issued), refund or arrange to refund the amount paid by the customer in accordance with the Directive, and compensate 15% of the tour fee (up to a maximum of HK$1,500).
  3. Under the Directive, if a licensed travel agent cancels an outbound package tour for reasons of force majeure (outbound travel), it may, when processing the relevant refund, charge ticket cancellation fees and the handling fees specified in the relevant tour information. The relevant fees charged by DeWonder Travel Limited are as follows:

(1) Ticket cancellation fee: the fee charged by transport service providers (airlines, railway companies, etc.) in response to the tour cancellation; the exact amount is subject to the final reply from the transport service provider;

(2) Handling fee as set out by the Company: if the tour has not been confirmed to depart, no handling fee is charged; if the tour has been confirmed to depart, the handling fee is HK$500 for itineraries of 5 days or less, and HK$800 for itineraries of 6 days or more; and

(3) Visa fee: if applicable, it will be handled in accordance with the relevant provisions of the Directive to Licensees. Handling fees already charged by banks and payment platforms will not be refunded. For details, please visit the Travel Industry Authority website (www.tia.org.hk).

  1. If, for reasons of force majeure (outbound travel), any item of an outbound package tour is changed before departure resulting in an increase in cost, the licensed travel agent must immediately notify the customer and, without prejudice to the customer's legal rights and obligations, allow the customer to choose to pay the additional cost to continue with the tour, or to withdraw before the tour departs. In the latter case, the agent must, in accordance with the Directive, refund or (if the customer paid by credit card) arrange to refund the amount paid by the customer. If the above change results in a reduction in the cost of arranging the tour, the agent must, in accordance with the Directive, refund or (if the customer paid by credit card) arrange to refund the relevant amount to the customer.
  2. If a licensed travel agent, for reasons of force majeure (outbound travel), changes any item of an outbound package tour after departure resulting in an increase in cost, it may charge the customer an additional fee. If the relevant change results in a reduction in cost, the agent must, in accordance with the Directive, refund or (if the customer paid by credit card) arrange to refund the relevant amount to the customer.
  3. For the avoidance of doubt: if a licensed travel agent, for reasons of force majeure (outbound travel),and are not required to compensate customers for cancelling a guaranteed-departure outbound tour under paragraphs 2.32 and 2.59 of the Directive.
  4. If, after an outbound tourhas departedthe licensed travel agentnot for unavoidable reasons (outbound)makes any change that results in increased costs, the agent must not charge the customer any additional fee. If the change results in reduced costs, the agent must, in accordance with the Directive, refund or (if the customer paid by credit card) arrange to refund the relevant amount to the customer.

Refund Arrangements for Withdrawing from a Tour / Free-and-Easy Package

  1. Except as provided by the Directive or otherwise stipulated, the tour / free-and-easy package fee (or any part thereof) you have paid to DeWonder Travel Limited may be refunded in the following circumstances:
    1. If your enrolment is not accepted by DeWonder Travel Limited, or the tour / free-and-easy package fails to form, and DeWonder Travel Limited notifies you in writing that the enrolment is not accepted or that the tour / free-and-easy package has failed to form, you may obtain a refund of all sums paid to DeWonder Travel Limited, after deduction of DeWonder Travel Limited's actual expenses and bank charges (if any);
    2. If the tour is cancelled (not for unavoidable reasons) and DeWonder Travel Limited notifies you in writing that the tour has been cancelled, you may obtain a refund in accordance with the Directive;
    3. If DeWonder Travel Limitedbefore issuing the free-and-easy package confirmation noticechanges the start/end dates, the assembly/dispersal locations, or the transport or accommodation arrangements, and you choose to withdraw from / terminate your enrolment in / participation in the free-and-easy package as a result of such change and notify DeWonder Travel Limited in writing, you may obtain a refund of all sums paid to DeWonder Travel Limited, after deduction of DeWonder Travel Limited's actual expenses and bank charges (if any);
    4.   2. In cases where Clause 35(d) above applies, if you have applied for an extended stay or any service upgrade request (such as an upgrade to business class, a single room, etc.) and it has been confirmed, all fees paid are non-refundable.

Refund of optional add-on services / individual travel services

  1. After you have submitted your order in writing to DeWonder Travel Limited and paid any (or part of the) service fee, you may not unilaterally change, cancel or claim. Unless DeWonder Travel Limited notifies you in writing that the optional add-on service / individual travel service is not accepted, no refund will be given. If you need to change or cancel an optional add-on service / individual travel service, DeWonder Travel Limited and/or the third-party service provider have the right to charge you an additional handling fee.
  2. If an optional add-on service / individual travel service is cancelled / delayed / changed due to DeWonder Travel Limited cancelling the tour / independent travel or due to DeWonder Travel Limited's fault, and an alternative service cannot be provided to you, then after DeWonder Travel Limited receives your written confirmation, DeWonder Travel Limited will refund you the service handling fee it has collected (if any). You hereby acknowledge and agree to comply with the relevant terms and conditions and/or policies applicable to the optional add-on services / individual travel services provided by the third-party service provider.

D. Travel Documents and Visas
  1. Unless otherwise stipulated by DeWonder Travel Limited, you must be solely responsible for applying for / preparing all valid travel documents required for the travel destinations / transit points to which the travel services go, including but not limited to passports, permits, visas and personal identification documents required by the (immigration) policies of the Hong Kong / travel destination / transit point governments. You must ensure that (i) on the last day of the travel services, your passport has a validity of not less than 6 monthsand has sufficient blank pages for immigration stamps or entry visas; (ii) the permit / visa is valid throughout the entire duration of the travel services; and (iii) your personal identification documents comply with the (immigration) policy requirements of the Hong Kong / travel destination / transit point governments.
  2. DeWonder Travel Limited will handle visa applications and reservation procedures based on the personal and travel document information you provide, including but not limited to flight tickets, transport tickets, hotel accommodation, attraction tickets, insurance, etc. If you change your personal and/or travel document information after enrolling in or purchasing any travel service, you must immediately notify DeWonder Travel Limited and pay all additional costs arising as a result.
  3. Unless otherwise stipulated, DeWonder Travel Limited shall not be responsible if you are unable to participate in or use the travel services and/or suffer any loss / damage / difficulty due to missing personal, travel document and visa information you have provided, errors or omissions in your travel documents, and/or the refusal of the travel destination or other travel location authorities to issue a visa. No refund will be given except in the circumstances stipulated in the Travel Service Cancellation and Refund PolicyNo refund will be given except in the circumstances stipulated therein.
  4. Even if you hold valid travel documents (including but not limited to passports, permits and visas, etc.), if during departure / entry you are refused or delayed departure / entry by the Hong Kong / local immigration department / customs or relevant authorities due to your personal reasons or any known / unknown reason, or this causes you to be unable to continue participating in or using the travel services (including but not limited to being placed in mandatory quarantine for a number of days, etc.), DeWonder Travel Limited shall not be responsible for any additional costs arising therefrom. No compensation will be given for the travel services you were unable to complete, DeWonder Travel Limited will not provide any alternative activities, and the fees you have paid to DeWonder Travel Limited are non-refundable.

E. Insurance and Health Condition
  1. The Travel Industry Authority advises travellers to purchase comprehensive travel insurance before departure. If you have not purchased any travel insurance, you will bear full responsibility for any additional costs and losses arising from special circumstances beyond the travel agency's control. Therefore, DeWonder Travel Limited requires you to purchase adequate travel insurance before the start of the tour/independent trip (whether the travel insurance recommended as an optional add-on service or other suitable insurance), and to read carefully the coverage (and exclusions) as well as the relevant terms of the policy, so as to cover any and all possible risks during the trip in both included and self-paid activities, including but not limited to damage/loss of personal belongings and luggage, personal or psychological injury, medical expenses in the event of death, and repatriation costs if you are unable to continue the tour/independent trip. You must provide DeWonder Travel Limited with written proof of adequate insurance purchase no later than 14 days before the start date of the tour/independent trip. If you fail to provide any comprehensive travel insurance information or refuse to purchase comprehensive travel insurance, DeWonder Travel Limited may treat this as your voluntary withdrawal from the tour/independent trip, and handle refund matters in accordance with the Cancellation of Travel Services and Refund Policy.
  2. If you need to make an insurance claim regarding insurance matters, please contact and communicate with the insurance company yourself. If you require DeWonder Travel Limited to provide relevant insurance proof documents or information, DeWonder Travel Limited has the right to charge you an additional handling fee.
  3. If you have any health or physical condition that may affect your participation in or use of any travel service, you must notify DeWonder Travel Limited when submitting the registration form/order. If DeWonder Travel Limited considers you unsuitable to participate in or use the relevant travel service, your registration may not be accepted, and no refund will be given except as provided in the Cancellation of Travel Services and Refund Policy.
  4. (If applicable) To protect the health of tour/independent trip participants and to comply with the quarantine arrangements of individual countries/regions, DeWonder Travel Limited has the right to require you to submit a personal travel record and health declaration form to DeWonder Travel Limited within the stipulated deadline before departure of the tour/independent trip, and to notify DeWonder Travel Limited immediately when there is a change in your personal travel and health status (including your close contacts). If you fail to submit a personal travel record and health declaration form to DeWonder Travel Limited within the stipulated deadline, or the declared content fails to meet the quarantine requirements of DeWonder Travel Limited and/or individual countries/regions, or if you fail to meet the quarantine requirements of DeWonder Travel Limited and/or individual countries/regions due to a change in your personal travel and health status (including your close contacts), then DeWonder Travel Limited may treat this as your voluntary withdrawal from the tour/independent trip, and no refund will be given except as provided in the Cancellation of Travel Services and Refund Policy.
  5. If, when registering for the tour/independent trip, you fail to submit a true and accurate travel record and health declaration form, or fail to immediately notify DeWonder Travel Limited when there is a change in your personal travel and health status (including your close contacts), but after departure are confirmed to fail to meet the health declaration or quarantine requirements of DeWonder Travel Limited and/or individual countries/regions (including but not limited to changes in the health status of yourself and/or your close contacts), DeWonder Travel Limited has the right to immediately terminate your continued participation in the itinerary, and no refund will be arranged. DeWonder Travel Limited has the right to recover the costs incurred as a result and/or claim compensation for losses from you.
  6. (If applicable) If, during the tour/independent trip, youAfter departure,if you discover that youmaybe unable to meet the health declaration or quarantine requirements of DeWonder Travel Limited and/or individual countries/regions (including but not limited to changes in your own and/or your close contacts' health condition), you mustimmediatelynotify DeWonder Travel Limited. After considering the actual circumstances and the quarantine requirements of individual countries/regions, DeWonder Travel Limited reserves the right to terminate your continued participation in the itinerary and to arrange a refund after deducting all actual expenses and handling fees. However, should your itinerary be delayed, cancelled or altered due to the relevant health condition or quarantine requirements, DeWonder Travel Limited will not arrange any alternative tour. Any additional costs incurred (such as quarantine costs, accommodation costs, etc.) shall be borne entirely by the customer.
  7. The various activities within the scope of travel services are all designed and arranged according to needs; however, when participating in activities you should comply with the guidance and instructions of DeWonder Travel Limited's staff and/or the service providers commissioned to provide services. You should also, prior to the activity, assess your own age, physical and psychological health condition, the local weather, natural environment, activity content and other factors, evaluate for yourself whether to participate, and shall bear all responsibilities and consequences arising therefrom. Whenever you consider it necessary, you should seek advice from a doctor or professional on your own.
  8. Certain activities within the scope of travel services may carry potential risks, including but not limited to outdoor hiking, mountaineering, skiing, ice skating, water activities, snorkelling, scuba diving, skydiving, hot air ballooning, mechanical rides, activities involving animals (feeding animals, watching performances involving animals, riding animals), etc., all of which may cause illness, loss or even injury and death. Before participating in such activities, you should clearly understand the potential risks involved and take full responsibility for your personal safety and health.

F. Personal Data Privacy Policy
  1. You understand and agree that DeWonder Travel Limited may collect your personal data, such as name, ID or travel document number, and contact details, for the purpose of applying for the relevant tour and providing services, and that the above personal data may be provided to DeWonder Travel Limited's business partners and/or its affiliates for the above purposes.
  2. You have the right to contact DeWonder Travel Limited's Personal Data Protection Officer by email at [email protected] and to request access to and correction of any of your personal data held by DeWonder Travel Limited.

G. Complying with Laws, Regulations and Guidelines During the Journey
  1. At all times you must comply with the laws, regulations, rules, orders and policies of the travel destination/other travel locations. If you breach such laws, regulations, rules, orders and policies, DeWonder Travel Limited shall not be responsible in any way, and reserves the right to claim compensation from you for all losses, damages and/or costs/expenses incurred by DeWonder Travel Limited arising from such acts.
  2. At all times you must comply with the guidance and instructions of DeWonder Travel Limited's staff, tour leaders, guides and/or the service providers commissioned to provide services. If you persistently ignore, fail to and/or refuse to comply with such guidance and instructions; or obstruct the normal activities and interests of the tour leader or group; or insult or harass other members, the tour leader or staff in action or words, DeWonder Travel Limited reserves the right to refuse your continued participation in the remaining itinerary of the tour/free-and-easy trip. All fees will not be refunded, and DeWonder Travel Limited and/or its business partners, contractors and/or third-party service providers reserve the right to claim compensation from you for the losses and damages and/or costs/expenses incurred arising from the above acts. DeWonder Travel Limited shall not be responsible for any activities after your continued itinerary has been terminated.

H. Travel Industry Compensation Fund Protection
  1. In accordance with the instructions of the Travel Industry Authority, tour receipts include a 0.15% levy to provide protection for travellers. The Travel Industry Compensation Fund provides that, where customers are unable to join a tour due to the insolvency or absconding with funds of a travel agent, affected customers may apply for an ex gratia payment of 90% of the tour fee.
  2. The Package Tour Accident Contingency Fund Scheme provides financial assistance to customers who suffer injury or death due to accidents while travelling on a package tour abroad.

I. Breach of These Terms and Conditions
  1. If you fail to comply with and/or breach any terms and conditions, DeWonder Travel Limited may, at any time at its sole discretion and without prejudice to any other remedies available to DeWonder Travel Limited: (i) refuse/terminate your registration/participation in a tour/free-and-easy trip or purchase of optional add-on services/individual travel services; (ii) forfeit any fees already paid to DeWonder Travel Limited; and (iii) claim compensation from you for the losses, damages and/or costs/expenses incurred by DeWonder Travel Limited arising from your above acts. No refund will be provided in such circumstances.

J. Liability
  1. Save as provided above, DeWonder Travel Limited shall not be liable for any loss, damage, cost or any other claim arising from matters outside the scope of the travel services, including but not limited to loss, damage, cost or any other claim arising from (i) your own transport to and from the designated assembly and dismissal points of the tour/free-and-easy trip, (ii) accommodation and/or travel documents and visas arranged by yourself, (iii) leaving the tour midway (DeWonder Travel Limited does not recommend leaving the tour midway), or (iv) during the free time as specified in the information pack and/or during any period in which you leave the group on your own before the itinerary ends.
  2. The images, facilities, equipment and descriptions relating to travel services set out in the information pack/suggested itinerary/registration form are provided only to give general information about the relevant services, such as hotels and local travel itineraries. DeWonder Travel Limited will endeavour to ensure that the information about the travel services you purchase (such as hotel facilities, equipment and descriptions) is accurate and up to date, but as such information is provided by third-party service providers, DeWonder Travel Limited does not guarantee any particular standard or grade in respect of any accommodation arrangements, flight conditions or any other services provided by third-party service providers.
  3. You agree toreleaseDeWonder Travel Limited, its business partners, its subsidiaries, contractors, third-party service providers, its affiliates, assigns and their respective directors, officers, shareholders and employees ("Relevant Parties") from any liability and compensation arising from or related to the acts or omissions of DeWonder Travel Limited and/or the Relevant Parties, or for any loss to participants themselves or their property caused by any transport cancellation or delay, theft, accident, death, personal injury, natural disaster, illness, crisis, political unrest, war, terrorist attack, etc., or for loss and damage arising from psychological trauma, such as depression or mental illness.

K. Indemnity
  1. You shall defend, indemnify and hold harmless DeWonder Travel Limited and all Relevant Parties against any loss, casualty, damage, liability, claim, deficiency, legal action, judgment, interest, award, penalty, fine, and cost and expense of any kind (including reasonable legal and professional fees) caused by your relevant acts, omissions, breach of laws and regulations or negligence.

L. Entire Agreement
  1. These terms and conditions (the documents referred to in these terms and conditions, including but not limited to the registration form, information pack and information provided to you from time to time by DeWonder Travel Limited or its business partners form part of these terms and conditions) constitute the entire agreement between you and the Relevant Parties in relation to the travel services, and supersede all oral or written communications, contracts and terms and agreements between the Relevant Parties prior to signing these terms and conditions.

M. Severability
  1. If any part of the terms and conditions in this agreement is held to be unenforceable or invalid, the remaining terms and conditions shall remain valid and enforceable.

N. Waiver
  1. Any failure or delay by DeWonder Travel Limited in exercising any right under these terms and conditions or seeking any remedy under these terms and conditions shall not in any event constitute a waiver by DeWonder Travel Limited of the relevant right or remedy. Any waiver by DeWonder Travel Limited of a breach of these terms and conditions by an individual participant shall not constitute a waiver by DeWonder Travel Limited of all breaches of these terms and conditions or a waiver of any breach of the same terms and conditions by that participant in other circumstances.

O. Amendments
  1. DeWonder Travel Limited reserves the right to amend these terms and conditions from time to time. You will be bound by the amended terms and conditions from the time you are notified of the amendments. Notice referred to in this clause includes but is not limited to DeWonder Travel Limited publishing the latest terms and conditions on its website or notifying you by email/SMS. These terms and conditions are based on the Chinese version, with the English version provided for reference only.

P. Jurisdiction
  1. These terms and conditions are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region. All disputes arising out of or in connection with these terms and conditions shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

1"Activity without transport and accommodation" refers to an activity taking place outside Hong Kong that does not include transport departing from Hong Kong and accommodation outside Hong Kong, for example a day tour assembling and dismissing in Shenzhen, or a half-day tour assembling and dismissing in Japan.

2 The "Withdrawal Date" shall be the day on which DeWonder Travel Limited receives your written notice informing DeWonder Travel Limited of your decision to withdraw on your own accord / terminate your registration / participation in the tour / free-and-easy trip, or, if you are deemed to have "withdrawn on your own accord" due to a breach of these Terms and Conditions, the day on which DeWonder Travel Limited issues the relevant written notice to you. In calculating the periods set out in this clause (such as 150 days prior or fewer than 150 days), the commencement day of the tour / free-and-easy trip shall not be included.

3Where the above Clause 35(c) / 35(d) applies, if the amount deducted by DeWonder Travel Limited is insufficient to cover all losses, damages and/or the costs/expenses already paid by DeWonder Travel Limited in respect of your registration for the tour / free-and-easy trip, DeWonder Travel Limited shall be entitled to claim compensation from you for the outstanding balance.

4In these Terms and Conditions, "day" refers to a "calendar day", that is, every day within a month, including Saturdays, Sundays and public holidays.
